Bloomington Probable Cause and DUI Defense Attorney

Why Was I Stopped?

A police officer must have probable cause or be able to articulate reasonable facts sufficient to indicate that a person in your vehicle was committing, was about to commit or had committed an offense to pull you over, regardless of the offense he suspects. A mere suspicion or a hunch on the officer's part is insufficient to justify the stopping of your vehicle.

At The Prior Law Firm, P.C., we perform a thorough evaluation of the circumstances that led to the stop. If we discover that the police officer did not stop you for a valid reason, any evidence from the stop may be suppressed and cannot be used in court. Additionally, your DUI arrest may be quashed.

We will make the prosecutor prove all aspects of its case against you, using any inconsistencies or illegal procedures in your defense.

Occasionally, law enforcement officials will stop a motorist when they have no authority to do so because there were no articulable facts sufficient to indicate that a person in the vehicle was committing, was about to commit or had committed an offense. For instance, if the office believes a motorist is lost or is having trouble with his vehicle, these reasons alone may be insufficient to justify stopping the motorist.

We will fight to protect your fourth amendment right articulated in the U.S. Constitution, which states: "The right of the people to be secure in their papers, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated."

Illinois and Bloomington Probable Cause and DUI Defense Lawyer

We will review the police officer's DVD of the DUI stop to evaluate the entire process by which law enforcement officials made the arrest. This includes the manner in which they tested your alleged intoxication – whether or not the officer properly administered the standardized field sobriety tests and any chemical testing, like the Breathalyzer.

The police officers must also operate by the law, and we will work to hold them accountable to the process they are charged to operate within.
